Court upholds settlement in asbestos lawsuits

The Supreme Court on Thursday agreed to let an insurance company settle some asbestos lawsuits for about 500 million in exchange for blocking any future litigation resulting from its long relationship with Johns Manville Corp., once the worlds largest producer of asbestos. Travelers Cos. had been named in lawsuits alleging that it tried to hide dangerous health effects of asbestos. The company argued that asbestos claims must be paid out of a trust created by Johns Manville in the 1980s and approved by a federal bankruptcy judge.Asbestos is a mineral that was commonly used until the mid-1970s in insulation and fireproofing material. Order Tossing Expert Grabs Attention in Asbestos Case
An order from a Georgia judge throwing out an expert witness and the asbestos suit his testimony was going to support have defense attorneys celebrating and plaintiffs lawyers bearing down for an appellate battle. The judge barred the testimony of a pathologist, saying that the doctor's opinion that any asbestos exposure causes injury "is not practically testable and has not been tested." Lawyers who defend companies from asbestos cases predicted the decision could influence other judges around the state.

Transocean seeks delay of oil spill depositions

Court blocks release of jailed militia members
A federal appeals court on Thursday intervened to block the release of nine members of a Michigan militia accused of plotting to overthrow the government, dealing a setback to the defendants as they gathered in a courtroom hoping to rejoin their families.A three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati issued a temporary stay about 12 hours after a federal judge in Detroit said she would no longer freeze her Monday decision releasing the nine with electronic monitors and other restrictions.With some already in street clothes, the militia members were transported to court to be processed for release Thursday. But they were returned to jail after a magistrate judge announced the appeals court decision.

U.S. court rejects Microsoft patent case appeal
A federal appeals court denied on Thursday Microsoft Corp's request that a full panel of judges rehear arguments in its long-running patent dispute with a small Canadian technology company.The decision is a blow to the world's largest software maker, which has been embroiled in a dispute with Toronto-based i4i Ltd over a feature in Microsoft's Word application for more than three years.Microsoft could yet take the case to the U.S. Supreme Court, or make a new request to the appeals court. The company is considering its options, according to a spokesman.A federal jury awarded i4i $290 million last August after finding that Microsoft had infringed a patent belonging to i4i relating to text manipulation software in the 2003 and 2007 versions of Word, Microsoft's word processing application.
