Court upholds LAPD ban on asking immigration status

A state appellate court Wednesday upheld the validity of the LAPDs Special Order 40, the controversial policy that bans officers from asking the immigration status of crime victims and witnesses. In affirming a lower-court ruling, the three-judge panel said the 30-year-old order strikes the appropriate balance between immigrants rights to equal protection and the Los Angeles Police Departments need to protect communities. In 2006, a conservative organization and a Los Angeles resident filed suit to challenge Special Order 40, saying it violates federal immigration law and asking the court to prevent the use of taxpayer money to enforce the order. Wash. to appeal felon vote ruling to Supreme Court
Attorney General Rob McKenna and Secretary of State Sam Reed say they will ask the U.S. Supreme Court to overturn an appellate court's decision that would give Washington state felons in prison and on community supervision the right to vote.McKenna and Reed announced their decision Wednesday. The appeal has to be filed with the court by April, and the state will seek a stay on felony inmates' ability to vote until the case is resolved.Tuesday's 2-1 ruling by a three-judge panel of the 9th U.S. Circuit Court of Appeals overturned the 2000 ruling of a district judge in Spokane. The appeals court says Washington state's felon disenfranchisement law violates the Voting Rights Act of 1965.

Malaysian Appellate Court Says Status As Muslim Up To Syariah Court
According to Bernama, Malaysia's Court of Appeal ruled yesterday that only the Syariah Court has jurisdiction to determine whether someone is Muslim.  The ruling came in an appeal of a 2005 lower court decision refusing to turn the body of former army commando and famed Mt. Everest climber M. Moorthy over to his Hindu wife for burial. (See prior posting.) The Kuala Lumpur Islamic Affairs Religious Council obtained an ex-parte order from the Syariah Court stating that Moorthy had embraced Islam prior to his death and it buried him in a Muslim cemetery. The Court of Appeal said that Moorthy's widow can apply to the Syariah Court to have the ex parte order set aside.  The widow's attorney said he would file for leave to appeal to the Federal Court.

Appeals court puts Mattel's Bratz takeover on hold
The pouty-lipped Bratz dolls can strut their stuff a little longer.A federal appeals court panel in Pasadena on Wednesday suspended an order that MGA Entertainment stop selling Bratz products this year, recall remaining toys and give ownership of the brand to rival Mattel Inc.Mattel won $100 million last year in a lawsuit that claimed copyright infringement and breach of contract because the dolls' designer was under contract to Mattel when he developed the Bratz concept.MGA was ordered to transition its Bratz line to Mattel by 2010, but the U.S. 9th Circuit appellate panel stayed the order until it can rule on MGA's appeal.MGA Chief Executive Isaac Larian says the order is a victory for fair competition.Mattel says it can't comment until the appeals process is over.
