A suit filed Thursday in Texas federal court challenges provisions
in the new health care reform law that place new restrictions on
physician-owned hospitals. The suit may be the only one by a
physician-owned hospital or other group challenging those
provisions, says Lindsey Birdsong, attorney for plaintiffs
Physician Hospitals of America and Texas Spine and Joint Hospital.
The suit names as a defendant Kathleen Sebelius, in her official
capacity as secretary of the U.S. Department of Health and Human
Services.

Mississippi sweet potato operation has been settled.A joint notice
filed with the U.S. District Court shows the settlement was reached
this past week in the suit against Ryan Alexander and Alexander

Texas Appeals Court Affirms Dismissal of Suit Against Board of Law Examiners
Ten years after the Texas Board of Law Examiners declined to admit
Kristofer Thomas Kastner to the State Bar of Texas, citing a
criminal arrest record and chemical dependency, a state appeals
court has affirmed a lower court decision dismissing a suit Kastner
had filed against the board and others. In his 2008 suit, Kastner
asked for money damages based on his inability to obtain employment
as a lawyer. The appeals court affirmed the dismissal of the case
on sovereign-immunity grounds.
Transocean seeks delay of oil spill depositions
The company that owns the sunken Deepwater Horizon rig argued in
federal court Tuesday that plaintiffs should not begin collecting
evidence and testimony on the Gulf oil spill until the November
deadline for claimants to file suit.Transocean Ltd. made its
arguments in Houston after the federal court there accepted the
company's petition to limit its liability in the oil spill to less
than $27 million, the amount the company says the sunken rig is
worth.U.S. District Judge Keith Ellison made no rulings Tuesday. He
scheduled two more court dates for early June, noting he wants to
focus on whether the suit should remain in Texas or move elsewhere
and whether depositions should begin immediately.Ellison indicated

Court rules against Santarus in patent suit
A U.S. district court ruled against specialty pharmaceutical
company Santarus Inc in its patent suit against Par
Pharmaceuticals, sending Santarus shares tumbling 48 percent after
the bell.The suit filed by Santarus and co-plaintiff University of
Missouri relates to Par's application to market a generic version
of Santarus' heartburn drug, Zegerid.The court ruled that the
patents-in-suit are invalid due to obviousness. It also concluded
that certain asserted claims are invalid for lack of written
description.The case is Santarus Inc et al v. Par Pharmaceutical
Inc, U.S. District Court, District of Delaware. No. 07-551.
