Remembering Francisco Castañeda

On Monday, we got a disappointing Supreme Court decision (PDF) that immunizes government doctors from personal liability for providing constitutionally inadequate medical care. But in that bad decision is an important acknowledgment that in Hui v. Castañeda "the Government filed a formal notice admitting liability with respect to...medical negligence." Francisco Castañeda lost his life at age 36 because of that negligence. The ACLU has been involved in the Castañeda case for more than three years. We urge that his memory be honored by Congress enacting reforms to the immigration detention system that caused his premature death. Court Applies Morrison Decision To Dismiss Extraterritorial RICO Action

In the U.S. Supreme Court's very recent decision in Morrison v. National Australia Bank Ltd., 130 S. Ct. 2869 (2010), the Court addressed the extraterritorial reach of Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5. The Court reaffirmed the presumption that "[w]hen a statute gives no clear indication of an extraterritorial application, it has none." In particular, the Court rejected the argument that Section 10(b) applied abroad because its definition of "interstate commerce" included activities between "any foreign country and any State." Immigrants with Mental Disabilities Deserve Due Process

Ever Francisco Martinez-Rivas, 31, suffers from schizophrenia and hallucinations, and exhibits unexpected patterns of behavior. After getting into an argument with his stepfather that turned violent, he was taken into police custody. ACLU of Southern California Demands Truth About Proxy Detention of Naji Hamdan
Since shortly after Naji Hamdan, an American citizen, was arrested and held incommunicado in the United Arab Emirates in 2008, the ACLU of Southern California has been working to obtain the truth about why the U.A.E. held, tortured, and charged Mr. Hamdan as part of the U.S.'s controversial "proxy detention" program.
