Ohio Court Ruling Could Change Dog Bite Lawsuits
In a case from northeast Ohio's Summit County, the court ruled 5-2
Wednesday that owners may be sued both under the state's dog bite
law and for more general negligence. The decision is a victory for
the family of a 12-year-old girl who was mauled by a dog and was
hurt on the head.A trial judge had allowed the girl's mother to sue
the owners only under the dog bite statute, limiting the money
award in the case. The jury awarded compensatory damages of $5,000
for the girl's medical bills and other costs. The Supreme Court says
the mother should also have been allowed to pursue a negligence

Judge Denies Request to Enjoin Auction of Classic Cars From Prominent Lawyer's Estate
A Texas judge denied a request for a temporary injunction that
would stop this week's auction of five classic cars from the estate
of prominent plaintiffs lawyer John M. O'Quinn. O'Quinn's longtime
companion alleged the cars were among 28 cars O'Quinn gave to her,
but the judge found she failed to establish a "probable right to
recover ownership." O'Quinn, who was killed in an automobile
accident last year, was a noted collector of classic cars. About
300 of the 860 cars in his collection have already been sold.
Parents, School Tangle Over Boy's Hair
Taylor Pugh has been suspended from pre-kindergarten because he
likes his hair a little on the floppy side. The 4-year-old sat with
a teacher's aide in a suburban Dallas school library Wednesday
while his friends played and studied together in a classroom. "They
kicked me out that place," said Taylor, who prefers the nickname
Tater Tot. "I miss my friends."
It's official: Don Henley wins summary judgment over Chuck DeVore on copyright claims
It's been a very bad month for Chuck DeVore. On June 8, the
Republican Assemblyman from Orange County finished third in the GOP
primary for the right to take on Sen. Barbara Boxer (D). And then,
just a few days later, federal Judge James Selna issued his formal
ruling on Henley's copyright and Lanham Act claims regarding
DeVore's videos that used Henley's songs to mock Boxer and
President Obama, soundly rejecting DeVore's fair use defense. While
I haven't done a line-by-line comparison of the tentative and final
rulings, it appears that the one substantive change favored DeVore
and his co-defendants. In the tentative ruling, Selna determined
that the defendants had committed willful copyright infringement,
but in the actual order, he declined to grant summary judgment in
favor of either pa...
